Claims Litigation Specialist
Job Description
The Claims Litigation Specialist is responsible for investigating, evaluating and resolving casualty claims involving property damage and injuries of moderate to complex exposure, with minimal supervision. The candidate would also be handling litigated files and managing defense counsel through the litigation process.
Alinsco is developing the next generation of leaders. In this role, you will work closely with our Litigation Director and Claims Director to learn our company philosophies and practices. Our desire is to see you grow into a leadership position and guide our legal matters. We manage claims and litigation to right and reasonable results.
This is a work from office position which will require your physical presence in our office in Fort Worth, Texas from 8:30 am to 5:30 pm Monday through Friday. This position requires the management and supervision of a department currently made up of two litigation adjusters and overall supervision of all claim litigation matters in Texas and other states. The position also requires reporting to the company executive team on litigation matters, interviewing and selection of defense counsel, negotiation and approval of hourly rates for defense counsel and review and approval of litigation expenses, including defense attorney bills.
In addition to the management and supervision of other adjusters, this position requires participation in round-table reviews of pre-litigation claims and adjusting and managing a number of claims involving coverage disputes, alleged excess exposure and extra-contractual exposure. This position also requires attendance at hearings, mediations or trials as required and responses to subpoenas and discovery and records requests served upon the company. Essential Functions and Responsibilities
* Verifies coverage and identifies potential exposures and coverage issues.
* Investigates facts surrounding claims and documents all investigations.
* Determines liability exposure and appropriate reserving.
* Maintains active diary and reporting.
* Reviews appraisals and medical information for settlements.
* Makes fair and equitable claim settlements within authority.
* Secures necessary Medicare and lien releases, etc.
* Manages litigated files and works with defense counsel.
* Offers counsel and adjusters direction and resolution options
* Guides roundtable reviews with adjusters and executives
* Supports the Claims Litigation Director
QUALIFICATIONS
* Bachelor’s degree.
* Graduation from an accredited Law School with a Juris Doctor or higher degree.
* Professional licenses: License to practice law in Texas; P & C Adjuster license.
*10+ years of legal experience in personal injury matters.
* Additional legal experience in insurance coverage matters would be a plus.
*10+ years of insurance claims handling experience involving bodily injury liability claims.
*Excellent written and oral communication skills and a proven ability to effectively communicate and work with insureds, adjusters, defense counsel, Plaintiff attorneys and mediators.
* Knowledge of casualty insurance policies (both auto and property).
* Knowledge of medical terminology.
* Knowledge of Fair Claims Practice Act.
* Knowledge of negligence laws of various states.
* Knowledge of generally accepted loss reserving practices.
* Knowledge of litigation practices and principles
* General computer knowledge, including Word and Excel programs.
* Effective time management skills.
* Experience in prioritizing, organizing and making decisions.
